Inside Colorado's latest move to regulate kratom sales

Colorado is making headlines once again by stepping up efforts to regulate kratom, the popular botanical known for its energizing and calming effects. The latest legislative move, bill SB25-072, recently passed by the state legislature, is now awaiting Governor Jared Polis’s signature. Here's everything you need to know about this new development.

What's in the New Bill?

The bill introduces significant changes designed to improve consumer safety and regulate the kratom market more strictly:

  • Age Restrictions: Sales of kratom products will be limited exclusively to adults aged 21 and older.

  • Retail Guidelines: Kratom products must be stored behind the counter, much like tobacco and alcohol, reducing easy accessibility.

  • Enhanced Labeling: Products must clearly display dosage guidelines, warnings about drug interactions, and precautions for pregnant women.

  • Controlled Alkaloid Levels: The bill sets a cap of 2% for 7-hydroxymitragynine, one of kratom’s most potent alkaloids.

These new guidelines aim to address concerns regarding product purity, consumer safety, and transparency in labeling.

The Legislative Journey

Initially, SB25-072 proposed more comprehensive regulations, including licensing for manufacturers and additional funds for enforcement. Due to cost-related objections, however, legislators scaled back the bill. A unique "super motion" helped fast-track the revised bill through the legislative process.

Senator Kyle Mullica (D-Northglenn), one of the bill's sponsors, expressed optimism, highlighting this as an essential step toward broader oversight: "I still think this is a step in the right direction to remove harmful products and move toward licensing."

Once signed into law, the new regulations will help ensure safer kratom products in Colorado, offering consumers greater peace of mind. Retailers will need to make significant adjustments to comply with product placement and labeling rules.
