Is Kratom legal in Georgia?

Peach State Curiosity: What’s the Deal with Kratom?

Georgia is known for peaches, college football, and southern charm—but lately, some folks are asking a different kind of question: “Is kratom legal in Georgia?” Whether you’re sipping sweet tea on your porch or scrolling through wellness options online, you might’ve come across kratom and wondered if it’s something you can legally explore in the Empire State of the South. Great news: we’ve brewed up a sweet and satisfying explainer that’ll walk you through everything you need to know about kratom laws in Georgia—without putting you to sleep.

Kratom Is Legal in Georgia

Yes, kratom is legal throughout Georgia, thanks to a law passed in 2019 that added consumer protections instead of criminalization. House Bill 551 was signed into law by Governor Brian Kemp and became effective July 1, 2019. It permits the sale, possession, and use of kratom for adults—but with some key rules attached.

You can view the full bill here: Georgia HB 551

Georgia’s Age Restrictions and Labeling Laws

  • 21+ Only: Kratom cannot be sold to or possessed by anyone under 21 years old.
  • Labeling Required: All kratom products sold in Georgia must include proper labeling, including ingredient disclosures and a disclaimer.
  • Prohibited Claims: Vendors are not allowed to make unproven medical claims about kratom products.
  • Violations: Non-compliance may result in fines and seizure of the products by the state.

For more information on this, check Georgia Code § 16-13-121.

Are There Any City or County Bans?

Nope! As of 2025, no cities or counties in Georgia have banned kratom. The 2019 law applies across the state, so local governments have not implemented restrictions that override state law. You can legally buy and use kratom whether you’re in Atlanta, Augusta, Savannah, or anywhere else from the Blue Ridge Mountains to the coast.
